1. Acceptance of Terms

By accessing and using the Liflio platform (hereinafter "the Service"), including the Liflio website and associated mobile applications, you agree to be bound by these Terms of Use (hereinafter "Terms"). If you do not accept these terms, please do not use the Service.

Liflio reserves the right to modify these Terms at any time. Changes take effect upon publication on the website. It is your responsibility to regularly review the Terms to stay informed of any modifications.

2. Description of Service

Liflio is an ad-tech platform specialising in the digitalisation of commercial flyers, discount coupons, and QR codes for the retail sector. The Service allows users to:

• Browse digital catalogues and flyers from partner retailers
• Access personalised discount coupons and promotional offers
• Scan QR codes to benefit from in-store advantages
• Receive notifications about relevant offers based on their preferences
• Compare prices and promotions across different retailers

3. Registration and Personal Data

Access to certain features of the Service requires the creation of a user account. When registering, you agree to:

• Provide accurate, complete, and up-to-date information
• Maintain the confidentiality of your login credentials
• Notify Liflio immediately in case of unauthorised use of your account

In accordance with the Data Protection Act of Ghana, Liflio is committed to protecting your personal data. The processing of your data is detailed in our Privacy Policy.

4. Use of Service and Data Processing

You agree to use the Service in accordance with these Terms and applicable law. The following activities are prohibited:

• Using the Service for illegal or unauthorised purposes
• Attempting to gain unauthorised access to Liflio's computer systems
• Copying, modifying, distributing, or reproducing the content of the Service without authorisation
• Using bots, scrapers, or any other automated means to access the Service
• Disrupting or attempting to disrupt the operation of the Service

Liflio collects and processes usage data in an anonymised manner to improve the Service and offer personalised content. This processing is carried out in compliance with the Data Protection Act and on the basis of your consent or Liflio's legitimate interest.

5. Third-Party Links and Data Sharing

The Service may contain links to third-party websites or services (partner retailers, payment platforms, etc.). Liflio is not responsible for the content, privacy policies, or practices of these third-party sites.

Liflio may share anonymised and aggregated data with its commercial partners to improve retail services. No personally identifiable data is shared without your explicit consent, except where required by law.

6. Intellectual Property

All elements comprising the Service (trademarks, logos, text, images, software, databases, etc.) are protected by intellectual property laws. Any unauthorised reproduction, representation, modification, or exploitation of these elements is strictly prohibited.

The trademarks and logos of partner retailers displayed on the Service remain the property of their respective owners.

7. Limitation of Warranty

The Service is provided "as is" and "as available". Liflio does not guarantee that the Service will be free from errors, viruses, or interruptions. Liflio strives to maintain the Service accessible at all times but cannot guarantee continuous availability.

Information regarding prices, promotions, and product availability is provided by partner retailers. Liflio does not guarantee the accuracy, completeness, or currency of this information.

8. Data Security and Retention

Liflio implements appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, destruction, or alteration. These measures include:

• Encryption of data in transit and at rest
• Strict access controls to computer systems
• Regular security audits
• Staff training on personal data handling

Personal data is retained for the period necessary for the purposes for which it was collected, and in accordance with applicable legal obligations.

9. Limitation of Liability

To the extent permitted by law, Liflio shall not be liable for any direct or indirect damages resulting from the use of or inability to use the Service, including loss of data, loss of profits, or business interruption.

Liflio's total liability, regardless of cause, shall not exceed any amounts paid by the user for use of the Service during the preceding twelve (12) months.

10. Indemnification

You agree to indemnify and hold harmless Liflio, its directors, employees, and partners from any claims, losses, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service or your violation of these Terms.

11. Termination

Liflio reserves the right to suspend or terminate your access to the Service, without notice or compensation, in the event of a violation of these Terms or conduct detrimental to the Service or other users.

You may delete your account at any time by contacting us at info@liflio.com.gh or through your account settings. Deletion of your account will result in the erasure of your personal data, subject to legal retention obligations.

12. Applicable Law

These Terms are governed by Ghanaian law. In the event of a dispute, the parties shall endeavour to find an amicable solution. Failing that, the competent courts of Ghana shall have exclusive jurisdiction.

You may also seek resolution through alternative dispute resolution mechanisms available under Ghanaian law.

13. Severability and Waiver

If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect. Liflio's failure to exercise a right under these Terms shall not constitute a waiver of that right.
